1. Conclusion of the contract

The following arrangement contains the conditions on the participation in the Affiliateprogramm Affilimoney.
It are valid at the time of the application position in our service for held ready conditions. By these conditions divergent regulations are accepted from us only by written confirmation on our part.

2. Affiliate (partner)

Your partnership as an Affiliate begins after your registration as an Affiliate. As an Affiliate you advertise on your website to the offer of the Advertiser. A contractual relationship originates, after the Affiliate has applied with an Advertiser and accepts this the Affiliate, provided that you did not become automatically activated.
The Advertiser is released from accepting the application of an Affiliate. In case of a rejection you have no rights compared against the Advertiser.

3. Advertiser

As an Advertiser you pay to the Affiliate which you have accepted a reimbursement certain by you.
With Pay-Per-Sale or Pay-Per-Lead the Advertiser must adapt his sides in such a way that our system can register these Sales/Leads.
We raise only 25% of an extra charge on all transactions as a reimbursement for the provision of our platform / Networks.
You preserve from us a code which it must be correctly integrated on your sides. You find out further details from us by email like in the Advertiser-Login area.
As an Advertiser you have to provide for the fact that a sufficient balance is given in your Advertiser account. Should your Advertiser account show no more credit, your program is inactive and you receive no more visitors about the Affiliates.
At the beginning of your Affiliate program a least insert is to be paid to us.

4. Commission

You can use the following reimbursement kinds for an Affiliate program:

1. Pay-Per-Click (PPC): For every valid click a fixed amount is credited to the Affiliate.

2. Pay-Per-Lead (PPL): Provided connections become according to the conditions of the respective Advertiser immediately or the commission will be payed after release of the respective Advertiser

3. Pay-Per-Sale (PPS) with proportional reimbursement: With this reimbursement kind the net market value builds the basic for the calculation of the commissions.

You can combine all reimbursement kinds.

Rules:

A valid click (Pay by click) follows, if an Internet user clicks voluntarily on the respective advertising of the Advertisers. The click is evaluated only, when the person on the side was led! Repeated clicks of an Internet user within short time are not evaluated, no clicks are also evaluated if the banners or text links are deposted to a wrong Url or the Internet user has a Firewall in use.
Repeated own clicks on banner or text links are not allowed - apart from unique tests with the installation of the links - and cause with nonobservance of this regulation a payback of the account credit and if necessary an exclusion from the whole Affiliate program.
Also inadmissible are clicks which are automatically caused by technical devices or are caused by a deception of the web visitor.
Clicks with an action compulsion are connected, as for example sending SMS news, the participation in a lottery or for the use in a Paid4 system, are only allowed with previous arrangement with the Advertiser.
The use of click generators is also recognised by our system and is pursued criminal!
A change of the link code, is allowed only with permission of the Advertisers.

All clicks are checked immediately and credited on your account. Besides, a logging follows and is evaluated seperat. Should a manipulation be ascertained, besides, the amount is drawn off to the Affiliate afterwards and it followed if necessary an exclusion from our program.

5. Liability of the Affiliate

The Affiliate sticks towards to Affilimoney and the Advertiser with which he has concluded contracts, for all compensation claims, liability claims and expenses which originate from the fact that a claim is asserted against them, therefore the website of the Affiliate against the competition law, commercial protective rights of third or other laws or orders expelled.

6. Availability / disclaimer of liability

Affilimoney does not stick for the constant availability. In special cases it can come to the fact which a low number of transactions cannot be registered. A claim against Affilimoney on the part of the Affiliate and Advertiseren does not exist.

7. Contract period

A contract originates, when Affilimoney sanctions your participation as an Affiliate. The contract can be terminated by both sides any time.
Also single Affiliate partnerships can be finished between Affiliate and Advertiseren at any time without specifications by the reasons, without which through this membership is concerned with Affilimoney. After notice no more reimbursements will be paid, even if an Affiliate does not remove the respective means of advertising from his website.

8. Changes of the conditions of participation

In case of changes of the conditions of participation you are informed of us by email. Every participant can terminate, provided that he does not agree with the change of the conditions of participation, the contract with Affilimoney with immediate effect.

9. Universal

With the judgment from the 12th of May, 1998 the district court of Hamburg has decided that one has the responsibility for the contents of the linked side if necessary with by the plug in of a link. This is able, according to LG, are prevented only by the fact that one expressly dissociates himself from these contents. Affilimoney refers on your sides with links to other sides on the Internet. Is valid for all these links: Affilimoney expressly explains that we have no influence on the creation and the contents of the linked sides. Herewith, therefore, we expressly dissociate ourselves from all contents of all linked sides on our homepage and these contents do not make us to appropriated. This explanation is valid for all indicated links and for all contents of the sides to which links lead.
